SECTION 1: TERMS OF SERVICE

1. ADHERENCE TO AGREEMENT

By downloading, installing, or playing Dojo Smash (the "Software"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not install or use the Software.

2. AGE REQUIREMENTS & MISREPRESENTATION

• Eligibility: You must be at least 18 years of age, or an emancipated minor, or possess legal parental/guardian consent to use this Software.
• Minor Safety: If you are a parent or guardian permitting a minor to use the Software, you agree to be bound by these terms on their behalf.
• Falsehoods and Liability: The issuer is not liable for any damages, loss of privacy, or exposure to content resulting from a user lying about their age. If you misrepresent your age to bypass safety features or legal requirements, you assume all associated risks and agree to indemnify the issuer against any resulting legal claims.

3. DISCLAIMER OF WARRANTIES ("AS-IS")

The Software is provided "AS IS" and "WITH ALL FAULTS." The issuer makes no representations or warranties of any kind concerning the safety, suitability, lack of viruses, or inaccuracies of this Software.

Defects: You acknowledge that computer games may contain "bugs" or defects. The issuer is not responsible for software errors, system crashes, loss of save data, or hardware interference.

4. LIMITATION OF LIABILITY & MISUSE

To the maximum extent permitted by Colorado law, the issuer shall not be liable for any special, incidental, indirect, or consequential damages whatsoever.

Misuse: The issuer is not responsible for your misuse of the Software, including but not limited to: unauthorized modifications (mods), cheating, hacking, or using the Software in violation of local laws.

Third-Party Conduct: The issuer is not responsible for the behavior of other players in multiplayer environments or community forums.

5. PROHIBITED USES

You agree not to:

• Reverse engineer, decompile, or attempt to derive the source code of the Software.
• Use the Software to harass, abuse, or harm others.
• Distribute or sell unauthorized copies of the Software.

SECTION 2: PRIVACY POLICY

1. DATA COLLECTION

We collect minimal data to run the game, which may include identifiers such as Device ID, IP address, and Username.

2. COLORADO PRIVACY RIGHTS

In accordance with the Colorado Privacy Act (CPA):

• We do not sell your personal data.
• We do not use your data for profiling or targeted advertising without consent.
• Users (or parents of users) may request the deletion of their data by contacting info@dojosmash.com

3. DATA SECURITY

While we take reasonable steps to protect user data, the issuer cannot guarantee 100% security. Use of the Software constitutes your acknowledgment of these inherent digital risks.

SECTION 3: DISPUTE RESOLUTION & ARBITRATION

1. BINDING ARBITRATION

Any dispute or claim arising from or relating to these Terms or the Software shall be settled by binding arbitration in the State of Colorado.

• The arbitration shall be conducted on an individual basis; class actions and class arbitrations are not permitted.
• The decision of the arbitrator shall be final and binding.

2. GOVERNING LAW

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

3. FINAL ACKNOWLEDGMENT

By proceeding to use the Software, you confirm that you have read this document in its entirety, understand it, and agree to be bound by its terms. You acknowledge that this agreement is a contract and has the same force as a signed written document.
